What is conveyancing?
In South Australia, conveyancing is the legal process of transferring ownership of real estate (land and buildings) from one party to another. It involves various legal and administrative procedures that must be completed before the property can be legally transferred.
Conveyancing typically involves a series of steps that includes:
- Contract preparation: The conveyancer will sometimes prepare the contract of sale, which outlines the terms and conditions of the sale, such as the purchase price, inclusions and exclusions and the settlement date.
- Searches and investigations: The conveyancer conducts various searches and investigations to ensure that there are no legal or regulatory issues that might impede the successful transfer of the property. This can include checking the title, checking for encumbrances (e.g., mortgages or easements), and verifying zoning and planning restrictions.
- Negotiations: The conveyancer may negotiate on behalf of the buyer or seller to resolve any issues that arise during the conveyancing process, such as issues related to the condition of the property or any disputes regarding the contract of sale.
- Settlement: Once all the legal and administrative requirements have been met, the conveyancer organises settlement, which involves the transfer of funds and the transfer of ownership of the property. The conveyancer also ensures that all relevant parties, such as banks and government authorities, are notified of the transfer.
In South Australia, conveyancing can only be performed by a licensed conveyancer or a practicing solicitor who is experienced in property law. It is important to engage a qualified conveyancer to ensure that the conveyancing process runs smoothly and that all legal and administrative requirements are met.

Land Division
If you’ve got a block of land you plan to sell, land subdivision can often be a way of achieving a better price.
The challenge comes in making sure that you optimise the value of your land before putting the property on the market. For example, in many cases land is worth much more if appropriate planning permission has already been granted for a Land Division, change of use or new dwelling.
If you’re considering subdividing land, a comprehensive knowledge of the relevant requirements and a good understanding of the land division process, is essential if you want to get the job done properly. For landowners who don’t have this expertise, our skilled conveyancers are the perfect solution.
