Probate and letters of administration
Generally speaking, a grant of probate from the Probate Office of the Supreme Court of SA is required to deal with the terms of a Will in South Australia. The Will is examined by the court if it is deemed to be valid, and then the grant is issued.
Probate & Letters of Administration are issued by the Court to the executor or executors named in the Will of the person who has passed away.
Letters of Administration is a grant by the Court to a person other than a named executor or executors, such as a close relation of the person who passed away. This might occur in the case where a named executor has already passed away or where the deceased person did not leave a valid Will.
